Anna Olijnyk and Stephen McDonald
State Tribunals and Federal Jurisdiction
Burns v Corbett  NSWCA 3 (3 February 2017)considered whether the NSW Civil and Administrative Tribunal was able to exercise judicial power to determine a dispute between residents of different states, and held that it could not, as it was not a Chapter III Court.
The decision is currently on appeal to the High Court, and potentially has significant implications for tribunals in other States. It represents the latest discussion of State tribunals and the exercise of judicial power.
