Constituting Public Service Markets: Access to Justice under the National Disability Insurance Scheme Act 2013

The legal framework of the National Disability Insurance Scheme is remarkably complex: seeking to operationalise core principles of human rights law through a statutory scheme also centred on market governance and economic cost/benefit models. In considering these tensions, this seminar will address the emerging tribunal and court decisions on the Act, focusing in particular on the key statutory requirement that funded supports be “reasonable and necessary”. It will argue that administrative law principles and institutions are central to ensuring that a scheme increasingly shaped by detailed rules and a financial sustainability calculus remains person centred.
